In the US under federal law any individual who can legally own a firearm can also legally build their own provided that it does not violate the NFA.
So if this was built in a state where it is legal, as long as the barrel length exceeds 16” and the over all length exceeds 26” and as long as it isn’t over .50 caliber and isn’t smooth bore, and as long as it isn’t capable of fully automatic fire(and can not be readily converted as such, like an Open Bolt) it’s completely legal to build and own.
There are many varying levels of state laws that regulate these things but on a federal level it’s completely legal and also is legal in most states.
However you can not build them with the intention of selling them, it has to be for personal use. Because if they were built to be sold it would be in violation and the individual would need a federal license.

Nothing overt in this ad. If they had the money and were willing to pay I don’t see why they would ban it.
I am all for boycotting The Superbowl. 75% of the reason I watch are for the ads. (Unless the Chicago Bears are playing). I now I will watch the ads and boycott them. Hate to do that, but that is how to effect the NFL.
My personal Starbucks boycott is going well, even though they might not notice, but it is good for me.
